Freehold Enfranchisement (Purchase) & Lease Extensions – Houses

Julian Wilkins & Co. Chartered Surveyors are specialists in residential house freehold enfranchisement valuation and negotiation on properties in the South East, London and elsewhere in England.

The 1967 Leasehold Reform Act gives leaseholders of residential houses the legal right to purchase their freeholds or to extend their leases. There are various qualification requirements including the original lease must have been for more than 21 years and the lease must be for the entire house. The legislation is considered a little complicated in respect of both qualification and valuation requirements and specialist knowledge is important.

There is generally little point in obtaining a lease extension of a house and it is normal for leaseholders to simply progress with a claim to obtain the freehold. The legal process can be used to purchase the freehold both when existing leases are long or short; and also as a way to remove an onerous ground rent.

Our Chartered Surveyors Julian Wilkins MRICS and Martin Geoghegan MRICS have extensive experience acting for leaseholders throughout the freehold purchase process. Each year we successfully settle a significant number of cases. Within the last year we have undertaken work in many diverse locations including London, Portsmouth, Liverpool and Rochdale.

We understand that the enfranchisement process can be daunting and stressful. Our team work hard to ensure that our clients are offered the very best personal service all through your relationship with us. We work closely with your legal professionals and ensure that you are kept up to date and informed with the very best advice at each stage of the process.

We offer our clients a freehold enfranchisement valuation service which includes an inspection of the property followed by undertaking the necessary research and freehold enfranchisement premium calculation.
We also can undertake the necessary negotiations over the premium payable and you can also count on us to negotiate a fair price and terms for your freehold purchase.

Both our Director, Julian Wilkins and our senior surveyor Martin Geoghegan have successfully represented clients in a number of cases taken to the First Tier Tribunal for determination. These cases have included ones where the current freeholder is absent or unknown.

Our valuation fees are fixed and competitively priced so that you can be fully aware of your costs. Our negotiation fees are normally charged on a time cost basis and are capped at an upper limit ensuring a saving is always made and so that you are not subjected to any unexpected costs.
